Terms and Conditions
- I acknowledge that Ultimate 4WD Training reserves the rights to make any cancellation, modification or variation deemed necessary to any training or touring activity, schedule or itinerary in the event of circumstances that are unforeseen or beyond the control of Ultimate 4WD Training howsoever arising and including, but not limited to, changes in road condition or accessibility, weather conditions, changes in any relevant legislation, regulations or local laws and availability of instructors.
- Ultimate 4WD Training reserve the rights to cancel or forfeit my place in any training or touring event conducted by Ultimate 4WD Training, in circumstances where the vehicle being used by me breaks down or otherwise suffers any sort of mechanical failure rendering the vehicle unsafe and/ or unusable for participation in the relevant training or touring.
- I agree that prior to participation in any training or touring event or activity I shall make full and frank disclosure to Ultimate 4WD Training of any illness or medical condition I may be suffering from and which might interfere with my ability to participate safely in any such event or activity, or upon such disclosure Ultimate 4WD Training shall in its discretion be entitled to suspend or terminate my participation or otherwise refuse my involvement in such event/s.
- I undertake to fully indemnify Ultimate 4WD Training, it’s directors, officers, trainers, assessors, servants and agents against all liability howsoever arising from injury, loss or damage caused to any third party or to the property of any third party be reason of any negligent act, breach of duty, default and / or omission on my part.
- I agree that is shall be a condition of my participation in any event or activity conducted or organised by Ultimate 4WD Training and involving the use of a motor vehicle be me, that such vehicle and it’s driver will at all times have current and effective insurance cover in respect of injuries to third parties and damage to property owned by third parties, and that Ultimate 4WD Training shall be entitled to inspect any documents relating to such insurance cover prior to the commencement of my participation in any event or activity.
- I acknowledge that four-wheel and / or off-road driving, observing four-wheel and / or off-road driving, learning and training in four-wheel and/ or off-road driving, and travelling in any vehicle being used for four-wheel / or off-road driving, and related activities, are potentially dangerous undertakings and in participating in such activities I do so wholly at my own risk.
- I agree that it shall be a condition of my participation in any event or activity of whatsoever kind conducted or carried on by Ultimate 4WD Training that I shall absolve Ultimate 4WD Training, it’s directors, officers, instructors, trainers, assessors, servants and agents from all liability howsoever arising from injury, loss or damage howsoever caused (whether fatal or otherwise) arising from participation in four-wheel and / or off-road driving, observing four-wheel / or off-road driving, learning and training in four-wheel and / or off-road driving and travelling in any vehicle being used for four-wheel and / or off-road driving, and related activities, or in any way whatsoever due to any negligent act, breach of duty, default and / or omission on the part of Ultimate 4WD Training, it’s directors, officers, instructors, trainers, assessors, servants or agents.
- I acknowledge that any person involved in four-wheel and / or off-road driving, observing four-wheel and / or off-road driving, learning and training in four-wheel and / or off-road driving, and travelling in any vehicle being used for four-wheel and / or off-road driving, and related activities, conducted or carried on by Ultimate 4WD Training, are permitted to do so on the express understanding that they do so wholly at their own risk.
- Ultimate 4WD Training has my permission to show, pass or copy my records, when requested by appropriate bodies, my self or other training institutions.
